TWC Aviation, Inc. ("TWC") has created this privacy policy (the "Policy") to explain our privacy practices so you will understand when and how personal information is collected, used, disclosed and protected with respect to our providing services and products (collectively, the "Services") via this website (the "Site") located at http://www.twcaviation.com. By using the Services and/or Site, you consent to the privacy practices described in this Policy.

We reserve the right to change this Policy at any time. If we make any material changes to our Policy, we will post a new policy on our Site and update the “last updated” date set forth above. Therefore, we encourage you to check this Policy whenever you use the Services to see if it has been updated since your last visit.

INFORMATION ABOUT YOU

YOU MAY BROWSE THIS SITE WITHOUT PROVIDING ANY PERSONAL INFORMATION WHATSOEVER AND YOU ARE NOT OBLIGATED TO PROVIDE ANY PERSONAL INFORMATION. For certain activities (such as registration for charter itinerary and pricing research), we may collect and process personal information you voluntarily exchange with us.

We generally collect two basic types of information with our Services, namely personal information and aggregate information. Personal information is information that is directly associated with a specific person or entity such as a user's name, address, telephone number, email address, and user-chosen IDs and passwords for any restricted Services or area of the Site.

Our definition of personal information does not include "aggregate" information. Aggregate information is data we collect about a group or category of services or users from which individual user identities have been removed. In other words, information on how you use the Site may be collected and combined with information about how others use the Site, but no personal information will be included in the resulting data. Aggregate data helps us understand trends in our users’ needs so that we can better consider new features or otherwise improve the Site. We may share aggregate information about our users with third parties for various purposes, including helping us better understand and improve our Services, and for advertising and marketing purposes.

Those are the types of personal and other information we collect. You should refer to the rest of this Policy to see how we use, disclose and protect this information.

Information You Give Us.

We may collect information you give us at various times when you register with us and use our Services. Examples include the following:

Registration and Transaction Information. If you register to use restricted Services or Site areas, such as charter itinerary or pricing inquiries, we may collect various kinds of contact information about you. This may include, for example, your name, telephone number, email address, or other information.

If you book a charter flight with us, it may be necessary to collect further information to identify you and any cargo or other items you are carrying, including without limitation information collected in accordance with the rules and regulations of the Federal Aviation Administration (“FAA”) or the Transportation Security Administration (“TSA”). You may submit such information to us online, or offline, as you wish. This information may include, for example and without limitation, your birth date, driver's license number and expiration date, passport or other identification numbers, the last four digits of your social security number, information pertaining to desired aircraft or crew, demographic information, or images, pictures or data files that could reasonably be used to identify you (such as a copy of your driver's license, passport and/or credit card), or your baggage, cargo, or other property. You may also be asked to create a user-chosen ID and password for your use when accessing restricted Services or Site Areas. In addition, we may collect information pertaining to any additional passengers accompanying you on a flight we are quoting for you or you are purchasing.

If you purchase or reserve a flight with us, we reserve the right to solicit and collect reasonable financial information about you and any other passengers, including without limitation credit card or other account information. Once again, you may submit this information to us online, or offline, as you wish.

DO NOT PROVIDE CONTACT INFORMATION FOR A MOBILE PHONE, TEXT MESSAGING OR ANY WIRELESS DEVICE THAT INCLUDES A DOMAIN NAME ADDRESS (SUCH AS “.NET” OR “.COM”) AS PART OF THE CONTACT INFORMATION UNLESS YOU CONSENT TO OUR CONTACTING YOU BY SUCH MEANS. FEDERAL LAW PROHIBITS THE SENDING OF COMMERCIAL EMAIL MESSAGES DIRECTLY TO A WIRELESS DEVICE THAT USES A DOMAIN NAME, UNLESS YOU HAVE FIRST GIVEN YOUR AFFIRMATIVE CONSENT.

We reserve the right to respond to user inquiries or requests sent via a wireless device that uses a domain name as such messages are not deemed to be commercial email and therefore, are not regulated by Federal law. However, when “computer to phone” commercial emails are prohibited by law, we may reject your wireless device contact information when such information is submitted for certain program features or services. We will attempt to notify you if we will need new contact information.

Submissions and Customer Service. From time-to-time. we may post surveys, contests or sweepstakes on our Site, which may request demographic information and customer feedback. Participation in these requests is completely voluntary and with each request you will have the choice of whether or not to participate and disclose information. We may also collect personal information if you provide it via email, message boards, or other interactive services. Please do not post any information that you hope or expect to keep private. In addition, we may collect and retain information that identifies you personally when you send us comments, questions or suggestions, or if you send us job applications, resumes, or other business contacts.

Automatically Collected Information.

We automatically receive certain types of information whenever you interact with the Site. For example, we may collect information pertaining to any transactions conducted by you on the Site, information pertaining to the files accessed or used by you, and standard access information, such as the time and date of accessing the Services, and usage of the Services. We use such information to help manage the effectiveness of our online advertising and to gather access information, such as counting the users who have visited those pages and compiling aggregated statistics about Services usage.

Web Beacons. “Web beacons” (also known as Internet tags, pixel tags, single-pixel GIFs (graphics interchange formats), clear GIFs, invisible GIFs, 1-by-1 GIFs, and web “bugs”) are tiny graphic files placed on a Web page which send a signal when a user has visited that page, allowing the site to collect standard access information, such as time and date of a page view, and a description of the page on which the web beacon resides. We reserve the right to use web beacons to help manage the effectiveness of our online advertising and to gather access information, such as counting the users who have visited those pages and compiling aggregated statistics about site usage; our web beacons do not contain any personal information and we do not link web beacons to personal information about you.

Cookies. We may also use “cookie” technology to collect information so that we can improve our Site by seeing which areas and features are most popular; to personalize the Site and improve the Site experience; and to allow you to visit the Site without re-entering your identifying information and/or password. Most browsers automatically accept cookies as the default setting. You can modify the setting to reject cookies or to prompt you before accepting a cookie from any sites you visit by editing browser options. If you decide not to accept our cookies, however, you may not be able to use the Site or Services to their full functionality.

No Information about Children.

Our Site and Services are intended for the general public. However, we do not knowingly, directly or passively, collect information from or about children under the age of 13, except as may be reasonably necessary for actual charter transportation of same, such as to foreign countries with immigration controls. If you are under the age of 13, please do not provide us with personally identifiable information of any kind whatsoever.

In the event that personal information regarding a child under the age of 13 is necessary to complete the purchase of a flight for that child, we expect and require that the parent or guardian of that child, or the purchaser of the flight, will provide the necessary information. Should a child whom we know to be under 13 send personal information to us, we will use that information only to respond directly to that child to inform him or her that we must have parental consent before receiving his or her personal information.

If we unintentionally receive personal information from children under the age of 13, we will make best efforts to comply with the Children's Online Privacy Protection Act of 1998 (“COPPA”) and reject and destroy such correspondence upon obtaining direct knowledge of such collection, except for the limited circumstances above. For more information about COPPA, please see the Federal Trade Commission's website at: www.ftc.gov.

CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83 permits customers who are California residents to request certain information regarding disclosure of personal information to third parties for their direct marketing purposes. For example, California residents have the right to request from companies conducting business in California a list of all third parties to which the company has disclosed personal information during the preceding year for direct marketing purposes. Alternatively, the law provides that if the company has a privacy policy that gives either an opt-out or opt-in choice for use of Personal Information by third parties (such as advertisers or affiliated companies) for marketing purposes, the company may instead provide information on how to exercise your disclosure choice options.

TWC qualifies for the first option above. We do not provide your personal information to any third party for their direct marketing purposes without your consent. If you would like more information with respect to your privacy rights under California law, you may contact us at the contact point below. Please reference your request as “California Disclosure Information.”
